Criminal Law 7/8-7/12/19

Students will be introduced to the fundamentals of Criminal Law. They will be given an understanding that crimes have elements that must be fulfilled in order for a person to be charged with a specific crime.

Students will learn that each crime has a set definition. We will explore intent and state of mind issues, for an example, should a person with diminished capacity be held responsible for their crimes.

Issues that will be covered include the motives for committing a crime, and possible legal defenses. In addition, strict liability crimes will be explained and discussed. Students will also learn that crimes like Murder, Drug Possession and Sexual Assault all have degrees or levels.

We will cover crimes against property such as arson, vandalism, burglary among other issues. Defenses to these crimes will also be explained, such as mistake, intoxication and consent.

Students will come to understand that if a person is charged with a crime, the state has the burden to prove that the accused did commit the crime. In addition, that a person has the right to remain silent and that they are intitled to an attorney either of their own choosing of an appointed Public Defender.
